By accessing or using nycadu.com (“the Site”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.
NYC ADU is an information platform that helps New York City homeowners understand the city's Accessory Dwelling Unit program, assess property eligibility, explore pre-approved plans, and connect with licensed contractors. We are not a construction company, architecture firm, law firm, or financial advisory service.
You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating an account or submitting forms.
Nothing on this Site constitutes legal, architectural, engineering, or financial advice. All information is provided for general informational purposes only. You should consult qualified, licensed professionals before making any decisions related to property development, construction, permitting, or investment.
Our eligibility checker uses publicly available data from sources including NYC PLUTO, DOB, and HPD. This data may be incomplete, outdated, or inaccurate. An eligibility assessment on our Site does not guarantee that your property qualifies for an ADU or that a permit will be issued. Actual eligibility is determined solely by the New York City Department of Buildings.
Contractors, architects, engineers, and other professionals listed on or referred through the Site are independent third parties. They are not employees, agents, or representatives of NYC ADU. We do not guarantee their work, qualifications, or conduct.
NYC ADU facilitates connections between homeowners, contractors, investors, and renters. We are not a party to any agreement, contract, or transaction between users. Any disputes arising from such agreements are between the parties involved.
ROI estimates, rental projections, property value impacts, and other financial information presented on the Site are for illustrative purposes only and do not constitute investment advice. Actual returns will vary based on factors outside our control.
Payments are processed securely via Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

You agree not to:
To the maximum extent permitted by law, NYC ADU's total liability for any claim arising out of or related to the Site or these Terms shall not exceed the greater of (a) the total amounts you have paid to NYC ADU in the 12 months preceding the claim, or (b) $100.
In no event shall NYC ADU be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
You agree to indemnify, defend, and hold harmless NYC ADU, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.
Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York County, New York. Each party shall bear its own costs. Judgment on the award may be entered in any court of competent jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law provisions.
